NYTTJANDE AV ÅNGERRÄTT

Kära XX/YY på Aegean Blue Vacations,
Efter ett antal samtal med XX under tisdagens förmiddag samt ett samtal med YY meddelar jag härmed att jag nyttjar min ångerrätt att häva avtal ###### som jag, AA, och min fru, BB, tecknade hos er måndagen den 6 juni 2011.
Via telefon med XX fick jag reda på att vi inte fick ångra köpet då vi skrivit på ett bindande avtal och blivit informerade om att vi inte har rätt att ångra köpet.
Jag har varit i kontakt med Konsument Europa som delgett mig information om att så är inte fallet. Det går aldrig att säga ifrån sig sin ångerrätt, det är en s.k. absolut rättighet, oavsett hur många papper jag skriver på.
Vidare blev jag informerad om att jag inte heller kunde nyttja min ångerrätt då Aegean Blue Vacations (ABV) inte säljer timeshares, som är vad EU:s direktiv skulle gälla. Nu är dock fallet så att det är ett direktiv som inte gäller längre, och har blivit ersatt av direktiv 2008/122/EG som också innebär att ångerrätten gäller inte bara timeshares, utan även så kallade semesterpaket, semesterklubbar och långfristiga semesterprodukter som är precis det som vi tecknat ett avtal för. Detta finns att läsa i artikel 6.
Grekland var en av de första länderna att genomföra detta EU-direktiv till en lag, och i mitt fall ger detta mig 14 dagars ångerrätt.
I och med ångerrätten kräver jag också att de pengar som vi betalat, per dags dato 2000 SEK, återbetalas omgående till vårt konto:

Enligt avtalet ska det också dras 5000 SEK torsdagen den 16 juni 2011, kreditkortet är nu spärrat och denna betalning kommer inte kunna genomföras till Er.

CANCEL OF AGREEMENT

Dear XX/YY at Aegean Blue Vacations,
After a couple of phone calls with XX during the Tuesday morning and a phone call with YY I hereby use my right to cancel our agreement ##### that I, AA, and my wife, BB, signed at your office during Monday 6th of June 2011.
I was told by phone with XX that I wasn’t allowed to cancel the agreement since we signed a bindning agreement and that we had been informed that we were not allowed to cancel the agreement.
I’ve been in contact with Konsument Europa that has given me the information that this cannot be true – it’s an absolute right to be able to cancel the agreement and cannot be negotiated away, no matter how many papers we sign.
I was also informed that I couldn’t use my cancellation rights due to the fact that Aegean Blue Vacations (ABV) doesn’t sell timeshares and the EU directions are only for these timeshares. However this is an old directive that has been replaced by directive 2008/122/EG which also includes vacation clubs and long-term holiday products which is what we’ve signed up for.
Greece was one of the first countries to implement this directive and legislative change and in this case it gives me 14 days of cancellation right, no matter what papers I’ve signed.
By the use of this cancellation right I also require the amount of money we’ve payed, per today is 2000 SEK, is to be refunded immediately to our account:

Our signed agreement also states that we should pay the rest of the money, 5000 SEK, on Thursday 16th of June 2011 however we’ve cancelled our credit card and the money will not be able to be transferred to you.
